On June 6, 2023, Chief Judge Thomas Schroeder of the Middle District of North Carolina appointed Lowey co-lead counsel along with Korein Tillery, Quinn Emanuel, and Cohen Milstein in the multidistrict litigation In re Crop Protection Product Loyalty Program Antitrust Litigation. The case is a major class action on behalf of farmers who purchased certain pesticides manufactured by Syngenta and Corteva, among others. Plaintiffs allege that these manufacturers entered into loyalty program agreements with major distributors and retailers to illegally foreclose market entry by generic pesticide competitors, causing the prices of these pesticides to remain artificially high.
