On September 29th, 2025, Judge Kai N. Scott of the U.S. District Court for the Eastern District of Pennsylvania granted final approval of a $2.625 million settlement for plaintiffs and the class represented by Lowey Dannenberg against NCB Management Services, Inc., in re NCB Management Services, Inc. Data Breach Litigation No. 2:23-cv-01236-KNS.
NCB Management Services, Inc. (“NCB”) is a national debt buyer, debt collector, and provider of accounts receivable management and call center management solutions for financial services companies, banks, and lenders.
The action alleges that NCB was responsible for a Data Breach that occurred on or around February 4th, 2023. In addition, the allegation states that NCB was responsible for the data breach, which caused class members’ personal information to be accessed, stolen, or compromised as a result of the unauthorized third-party access to NCB’s system. The personal information included their first and last names, addresses, phone numbers, email addresses, dates of birth, employment positions, pay amounts, driver’s license numbers, Social Security numbers, account numbers, credit card numbers, routing numbers, account balances, and/or account statuses.
Plaintiffs submitted legal claims that highlight negligence, breach of implied contract, unjust enrichment, violations of state consumer protection, data privacy statutes, and the Driver’s Privacy Protection Act, declaratory and injunctive relief, and breach of contract.
As Co-Lead Class Counsel on the matter, Lowey Partner Christian Levis, along with Anthony Christina and Amanda Fiorilla, prosecuted the matter.
