On January 30, 2023, Judge Cheryl R. Zwart appointed Lowey Dannenberg, P.C. as one of two Co-Lead Interim Class Counsel representing a proposed class of consumer plaintiffs in In re: Data Security Cases Against Nelnet Servicing, LLC, No. 4:22-cv-3191 (D. Neb.).
The consolidated class action alleges that Nelnet Servicing, LLC (“Nelnet”) failed to properly secure, safeguard, and protect the personally identifiable information (including names, addresses, email addresses, phone numbers, and Social Security numbers) of their student loan borrowers (the “Data Breach”).
In a contested three-way leadership battle, Judge Zwart highlighted Lowey Dannenberg’s “pre-litigation planning” which it found “exemplifies a commitment to limiting duplicative filings and work, resulting in less expense and delay for the named plaintiffs, the putative class members, the defendants, and the court.” Op. at 12. Judge Zwart ultimately found that Lowey Dannenberg was the “best choice for representing the interests of all of putative class members.” Op. at 14.
Lowey Dannenberg’s appointment in the Nelnet Data Breach follows its recent leadership appointments as Co-Lead Interim Class Counsel in November 2021 in In re USAA Data Security Litigation, No. 21-cv-05813 (S.D.N.Y.); June 2020 in In re Wawa, Inc. Data Security Litigation, No. 19-cv-06019 (E.D. Pa.); and March 2020 in In re Rutter’s Inc. Data Security Breach Litigation, No. 20-cv-00382 (M.D. Pa.).
