Global Fragrance Manufacturers investigation
Did you Overpay for Fragrance Products or Consumer Products Containing Fragrances?
Lowey Dannenberg, P.C. is investigating claims that global fragrance manufacturers Givaudan SA, International Flavors & Fragrances, Inc., Symrise AG, and Firmenich SA conspired to increase prices of fragrance compounds and ingredients (“Fragrance Products”) in violation of U.S. and international antitrust and competition laws.
On March 8, 2023, the Swiss Competition Commission announced an antitrust investigation in the fragrance industry involving Firmenech, Symrise, International Flavors & Fragrances and Givaudan. Dawn raids were conducted in coordination with the European Commission, the United States Department of Justice Antitrust Division, and the UK Competition and Markets Authority. At this time, the European press reported on unannounced inspections, dawn raids and formal requests for documents sent to these four companies, as well as a global industry association, the International Fragrance Association, related to a global antitrust investigation in the market for Fragrance Products.
Shortly thereafter, a class action lawsuit was filed against Givaudan SA, International Flavors & Fragrances, Inc., Symrise AG and Firmenich challenging a conspiracy to unlawfully increase prices of Fragrance Products. Collectively, these four companies comprise over 70% of the fragrance compound market. The complaint alleges that the defendants’ price increases, which occurred in parallel starting in 2018, unlawfully increased prices of Fragrance Products, harming purchasers.
