If you have searched online for information about a class action lawsuit or settlement, you have probably come across a variety of websites promising to help you file a claim. Many of these are “Claim Aggregator” websites. While these sites can be helpful, it is worth understanding how they work and why Claim Magic is different.
What Are Claim Aggregators?
Claim Aggregator websites typically advertise existing class action settlements and offer to help individuals file their claims. These sites are third-party companies that act as intermediaries, pooling claims from multiple individuals and then charging a fee, often as a percentage of the value of your claim. While Claim Aggregator websites can be a convenient way to find out about settlements you may have missed, there are three key points worth knowing before you use one.
- They are often not affiliated with lawyers or parties to the settlement. Claim Aggregator websites often do not represent class members. Instead, many work to pool claims and then charge you a filing fee. What most people DO NOT realize is that Claim Aggregator websites charge for a service you can otherwise access for free by directly contacting the settlement’s court-appointed lawyers or its administrator.
- Every class action settlement has a website that will let you file your claims for free. Examples include the Google Assistant Privacy Litigation and Period Tracker Data Privacy Litigation. These verified sites, which are approved by a court and set up directly by the attorneys who litigated the case (i.e., “class counsel”), are designed to be straightforward and easy to use. If you ever need assistance, you can contact the administrator or the lawyers directly, free of charge. While third-party aggregators make it sound like you are filing a claim for payment from the settlement directly, they are just middlemen charging a fee.
- They overstate the potential settlement payment. This is done purposefully to entice you to file claims through them for an overstated claim amount or to “opt out” of a settlement—and exclude yourself from receiving the benefits entirely—in order to pursue individual claims with different lawyers. For example, below is a real landing page by an aggregator site that was cited in the Lopez v. Apple, Inc. case, advertising up to $100,000 per claim! No. 4:19-cv-04577, ECF No. 361-1 (N.D. Cal.).
