Lowey Defeats Containerboard Manufacturer’s Motions to Dismiss

On September 4, Lowey Dannenberg defeated Defendants' motions to dismiss in Artuso Pastry Foods Corp. v. Packaging Corporation of America, et al., 1:25-cv-08856 (N.D. Ill.).

In denying the motions to dismiss, Judge Mary M. Rowland ruled that Plaintiff plausibly alleged that Defendants Packaging Corporation of America, International Paper Company, Smurfit Kappa North America LLC, WestRock CP, LLC, Georgia-Pacific LLC, Cascades Inc., Cascades USA Inc., Cascades Holding US, Inc., Pratt Industries, Inc., and Greif Inc. engaged in a price-fixing conspiracy.

Plaintiff alleged that Defendants, the largest producers of containerboard, linerboard, and containerboard products (including cardboard boxes), colluded to raise prices by more than 30% through multiple parallel price increases between 2020 and the present. The case will now proceed to discovery.

Lowey's attorneys Vincent Briganti, Raymond Girnys, Margaret MacLean, Nicole Veno, Xin Huang, and Katherine Boyd represent purchasers of containerboard products.
